...i see your point but i think that the fact that they were all minors acting in the worst possible way. a drunk girl cant defend herself and if she was flirting with one of the guys before the incident, why was another guy fucking her too? they clearly took advantage of her. posting pics on instagram didnt exactly help paint them as good boys behaving badly.

i think the court just wanted to send a message from coast to coast and boarder to boarder that we/i/us cant be treating each other that way. there are plenty of wide awake willing girls to accommodate. at the end of the day she didnt give her permission to engage in the act wheter or not she bares some kind of responsibility herself but shes still a victim i think.

Not quite right... she somehow managed to remember and testify to saying No. Kind of convenient if you ask me.

What made it rape were the idiots fucking around with a passed out girl. That shit used to fly even a decade or two ago but suddenly chicks were unable to give consent when they were drunk according to the law. So technically you COULD get popped for rape anytime you fuck a drunk person.

And what if before passing out she had consented to this in her drunken state? The 2 assholes were probably drinking themselves I assume so their ability to go "Wait, she is drunk and can't give consent" is muted or mitigated as well.
