    Any news on Howard's lawsuit appeal? When is the court going to rule?

    Cuz when it does happen, i need to tune into his next live show and listen to the meltdown.

    Waaaahhhhhhhh, i didnt get $300 million.

    The women judges on the panel are synching up their times of the month and scheduling a lot of activities for their kids before they write their decision late one afternoon.

    Are you kidding? Howard won't give up. If he loses (again), he'll appeal that decision to the New York Court of Appeals, which I believe is the highest state court in NY (like a state Supreme Court in just about every other state).

    It was interesting listening to Bubba talk about his case, and how the Plaintiff there (rival DJ) lost, but is squeezing Bubba by threatening an appeal.

    That won't work with SiriusXM Howard, they've got more cash than you! Better log on to LegalZoom!

    Are you kidding? Howard won't give up. If he loses (again), he'll appeal that decision to the New York Court of Appeals, which I believe is the highest state court in NY (like a state Supreme Court in just about every other state).
    NY State Courts are a bit different than most states.

    I recall reading that if the Appellate Division unanimously rules against the plaintiff, the CoA does not have to hear the case.

    the trial was online live..bubba was sweating..he did what he was accused of but it was decided he had free speech protection..he won't mess with that guy again and probably never trash another disk jockey or goverment official

    Yeah, Supreme Courts (or the Court of Appeals in NY) in every state (as well as the U.S. Supreme Court) have discretionary review. They pick and choose what they want to hear.

    The appeal getting shot down is gonna be GREAT melt down radio!

    I hope SiriusXM doesn't puss out and goes after Howard for attorneys fees (which would mean marbles directly out of Howard's pocket). They probably will agree to each party bearing their own respective costs and fees though, just to keep the peace. Even under that scenario, Howard's gonna be out a few precious marbles...

    ...i dont think so. i watched the trial and the only thing they might have to say on appeal is the plantiffs lawyer was set up by the defense to get busted for a dui. if the pubic headed midget feels like bubbas defense set his lawyer up then he should sue his lawyer for being a drunk and not able to focus on his case. it was clearly a free speech issue and the jury saw it plain as day.

    howard otoh will appeal again if he loses, we're talking about 300 million here so why not? but as pointed out the coa doesnt have to entertain it providing the lower courts decision is view as correct and the hearing was fair. its not that easy for judges to over rule their peers unless there was a blatant oversight or mistake by the court. imo the first court had it right, the contract was ambiguous at best. the concept might have been there but it was short on details and procedures.

    besides how can howard claim all those subscribers when hes too chicken shit to reveal publically the exact numbers of how manys subscribers listen to howard stern. an embarrassing fraction of what it use to be.
