It's in his contract that they can't use his likeness unless he approves it. Everyone else has that they can appear in Sirius promotional literature or advertisements. It would be like James Gandolfini saying he doesn't want to be in any promotional advertisements or posters for The Sopranos or HBO.

You are not far off. It's in Howard's contract that if they (SIRIUS/XM) use his likeness in advertising, not only do they need his approval but they also have to pay him for the privilege. As always Howard wont do anything unless he can profit from it.
