
As he said in the clip, Howard will never give up. This fuckery will end only when the judicial system shuts him down. Most likely Howard has just one more shot. If the Court of Appeal finds against him, which it will, Howard has no right to a second appeal. He will have to convince a higher court to hear the case. And the chances of that happening are slim and none.
He mentioned that there was a clause written that if XM took over Sirius, he would be compensated, or something like that. He never imagined that the reverse would happen and expects $$ because Sirius took over XM. He flat out admitted that he never thought that would happen, yet he expects some sort of payout for this. He's just pissed that the great and powerful Buchwald didn't write up as iron-clad of a contract as he thought. He comes across very badly here. I don't think many listeners are going to be outraged because Stern isn't getting more millions.

Howard used the Ben lie to make his lawsuit rant seems somewhat spontaneous.
Howard concocted this entire tale with legal counsel.
The whole 60 percent of 23 million is lawyer speak.

My personal belief - fully supported by the language of the contract - is that there was never an agreement to pay Howard bonuses based on the total number of subscribers of both companies combined after a merger.
Howard is making it up. It's a marble grab.
If Howard is not making it up, his lawsuit should be against Buchwald and whoever else represented him in the contract negotiations. They failed to get the full agreement in writing. That's on them.

Yup. Howard is fucked. He will NEVER win this one. Never. My belief is Don convinced Howard this would work. Because Don gets a piece of the bonus payment action too. So I can imagine a phone call where Don called Howard one day and said "Ya know, with the companies merged now I think we have hit subscriber totals which trigger bonus payments.." Then Howard - (who was probably oblivious to all this prior) - went, "I trust you Don, do what you have to do."
Then.. when the entire scheme went south on Don and Howard.. Howard got pissed off... and now it's a matter of pride for him. But he is dead wrong and should give up.

The sirius contract has nothing to do with the xm subscribers UNTIL they became sirius subscribers. Howard's beef is that HE forced the merger so he is the one who brought those subs to sirius.
I'm not saying he is right or wrong, but that's his argument. Whether they listen to him or not should not be relevant in his mind. If he hadn't signed with siri then xm would be here today is his only fight. Judging by the swing in subs he might stand a chance arguing that, but then he would have to show that nfl, mlb, and nascar had minimal impact so maybe that is why they are not going after that aspect of the argument.
There was a bonus list out there somewhere that showed sub numbers and bonus pay. It looked like he had not been paid for one level bonus that was attained. Why in hell doesn't he go after that cash where it was spelled out and not paid as well? That has bugged me since I saw it.
