    Howard Stern 'Wigged Out" about lawsuit 01-04-13

    What is a risk?
    A risk is taking less guaranteed salary with a well defined back-end
    Our Howard wants all the money....upfront and back-end.....no risk involved.


    60 percent of 23 million?
    Translation.....ALL of Sirius and the the XM subscribers that have the Sirius package.....isn't that 60 percent of 23 million?
    In conclusion Howard is saying that all subscribers that the the ability to listen to him are listening to him......and YOU must prove that they are not.

    I said it before and I shall say it again.. Howard is wrong on this.. I UNDERSTAND it Howard. I really do.

    #1 - XM subscribers did not subscribe to XM because of Howard Stern.

    #2 - When Howard's contract was penned it was between Sirius and Howard, period. Not Sirius and XM and Howard. When the contract was written XM subscribers were not to be factored in to any subscriber totals. (They were 2 different companies at that time.)

    #3 - Howard's Sirius contract sais that if he meets certain subscriber targets he gets bonus payments. That was agreed to in good faith to ONLY mean Sirius subscribers.

    #4 - Then the companies merged, and Don/Howard/Lawyers are trying to SHOEHORN the XM subscribers into the target totals.. in order to TRIGGER the bonus payments.

    It's really that simple. Yes it is one company NOW. But when the contract was written the INTENT was Sirius subscriber totals. Period. The intent of the contract was not to include XM subscribers added to Howard's Sirius subscriber totals.

    Howard.. sorry buddy.. you're wrong on this one and are just making lawyers rich.

    He's full of shit too. The CEO of XM mentioned that Sirius offered him an astronomically huge deal that they could never compete with. I wish I could remember the exact quote, because I remember the implication was that XM was blown away by how much money Sirius was giving to Stern.

    He grabbed the money. Not a huge risk, Stern.

    howard risked nothing. he signed a contract for approx 100 mil a year (guaranteed) without putting up a cent of his own money.
    he is full of shit, he had nothing to lose....and even if he did he was still guaranteed the money.

    the biggest risk he ever took was to foolishly marry the bimbo. he risked his own children's legacy for a golddigger(although i'm sure alison probably made sure the girls would be protected).

    Yes.. He will lose again. Any judge or lawyer not being paid by Howard can easily see that the intent of the contract was between Howard and Sirius. It did not include A) any merger, and B) XM subscribers. Howard/Don and their legal team are now trying to shoehorn XM subscribers into the deal. To trigger bonus payments.

    Howard is only throwing out good $$$ arguing this... eventually he has to give up and realize that he is just not going to win this one.

    Does anyone remember the date of the Stern show where Howard explained that Judge Barbara was wrong because of her vaginer and her kids being a distraction late in the day ?

    The judge threw out the lawsuit on Monday, April 18, 2012. The story hit the papers on Tuesday or Wednesday, so my guess is Stern addressed it on one of those days (the 19th or 20th), or on the following Monday (April 23rd). You can check out Marksfriggin.com around those dates to see which day it was.
