There is 0 basis for Howard to pay attorney fees unless there is a provision in the contract that provides that the losing party in any litigation is responsible for attorney fees

I'm assuming this is a breach of contract suit, in any breach of contract suit you can sue for damages if the court actually finds that the contract was upheld. If you really wanted to be a prick, you could even sue for defamation, saying that this will hurt your ability to hire future on air talent. For example, "Because Mr. Stern perpetuated the notion that SiriusXM does not honor talent contracts, we feel that our ability to maintain equity in the company, which in the case of the arts is in fact talent, has been damaged."

EDIT: The reason I think that SiriusXM would never do this is because they still want Howard working there and being semi-placated, of course. Although, this is the perfect chance for Malone to establish rule with an iron fist...

Because the rich and celebrities get away with this all the time, and it wastes our tax dollars. Try suing your boss for breach of contract for no good reason, and see if you don't end up paying damages.

EDIT: I forgot to explain, the main reason why this doesn't affect the rich proportionately is because the damages aren't relative to your income, attorneys fees and sanctions are not that different whether you make $50k or $100,000,000 a year. In fact, the sanctions would be the same regardless of whether you hire the best NYC law team or represent yourself pro se.
