As a tax payer, I am pissed that Howard is filing a frivolous lawsuit and you should be too. It really does waste the time and money of the judicial system, and over the years Howard has constantly called out people for filing frivolous and wasteful lawsuits that Robin talked about during the news. If the judge wanted to, she could sanction Howard, but it would be for a pittance of money (under 5k).

You can do that, but assuming the defense files a declaration making the judge aware of it, she may well make Howard pay SiriusXM's legal fees (which could be a decent chunk of change) as payback. It isn't against the law, but it's perfect fodder for a declaration by the defendant and can definitely influence the judge even though it isn't supposed to.

Why should she be above making Howard pay SiriusXM's legal fees, which is what she SHOULD do if the suit was without merit? I hope SiriusXM hire 20 Johnny Cochran clones to handle this one.

There is 0 basis for Howard to pay attorney fees unless there is a provision in the contract that provides that the losing party in any litigation is responsible for attorney fees

That's why I included "should" do. Most judges have super-ego's too..... I just think it would be kool if she put out a statement explaining exactly why she is right and Howard is wrong.
