No-refusal Weekend. Cops get a warrant to draw your blood.

They do this in Dallas on all the big party weekends. Some folks think its a great idea, others think it is a huge rights violation.

If you refuse the breath test, they get an instant warrant and take you downtown and draw blood.
Do they do this where you live?

    Story below-

    FORT WORTH, Texas -
Several North Texas police departments are going to make sure you don't drink and drive.

Fort Worth and Dallas police departments are just two of the local agencies joining the No Refusal DWI initiative starting tonight.

Starting at 6 p.m. Friday, if you are pulled over and police suspect you've been drinking, officers can obtain a search warrant almost instantly to take your blood sample.

Local judges work out of mobile command centers. If you're pulled over and refuse a breathalyzer test, the judge will sign the warrant and a trained investigator or registered nurse will take your blood.

The no-refusal initiative ends January 1.

The idea is to cut down on the number if impaired drivers on the road. According to the Texas Department of Transportation, there were 3,884 alcohol-involved crashes in Tarrant and Dallas counties last year.

Giving cops the power to arrest drunk drivers is a really bad idea. Wahhhh.. My rights were abused.... Stop drinking all night and you'll be fine moron.

I am well trained. I dont really drink when I go out on these weekends. I really dont drink much at all anymore.
Just curious if people felt violated or thought something like this is was needed.

January 1st, California no longer offers the option for urine test.

    Blood or breath.

This is at least the third time they've done it. I've not heard of any problems in court.

They do it often. 2 or 3 times a year usually.
St. Patricks Day weekend, 4th of July, New Years weekend. It just takes a cop saying you were "acting weird" or something like that...next thing you know your are in a trailer in some parking lot, strapped down with some part time, Indian nurse jabbing you with a needle

I'd bet that this issue just hasn't slithered its way to the ACLU yet. Outside of Texas, I don't think this law has been publicized a whole lot.... But, if you think about it, its not lawful to forcibly take someones bodily fluids (without their consent) when there's no active trial or there's been no conviction by a jury of anything... In California, you can refuse to allow them to take your blood or take a Breathalyzer ...But, by doing so, its an automatic 180 day suspension of your license.... I'm all for nailing anyone who drives under the influence... But, you just cant have government agencies forcing themselves on you so they can steal your bodily tissue...

I miss the good old days. Back in '96 or so I was blazing up the Hollywood Freeway on my Sporty at about 80mph and didn't see the HWY Patrol I just whizzed past...probably because I had alcohol buzz on...enough for a DUI, I'm sure. Got pulled over, refused a breathe test, so they took me downtown. I proceeded to fuck with every "sobriety" test they tried on me for about 3 hours, including laughing uncontrollably when some cop said I was obviously on LSD or some shit.

It took until until they threatened to forcibly strap me down and take blood that I agreed. They took blood, I spent the night in LA county lockup and was let go the next morning with some bullshit $100 ticket. No DUI, no loss of license...nothing else. Today...I would have been fucked.
